Bari Lawsuit: Post-Trial Maneuvering Continues

Although a federal jury returned a stunning verdict last June in favor of Judi Bari and Darryl Cherney in their landmark civil rights lawsuit against four FBI agents and three Oakland Police officers, the case is by no means settled. After a delay of more than two months, U.S. District Judge Claudia Wilken ordered entry of a partial verdict, which occurred on August 13, paving the way for both sides to file post-trial motions. Judge Wilken will hear these motions on November 1 at the Oakland Federal Courthouse. The defendants are likely to move to throw out the verdict and/or to nullify or reduce the damage award. This motion, according to the plaintiffs' attorney, Dennis Cunningham, will be a preview of their expected appeal of the verdict. If denied, the defendants have 60 days to file notice of an appeal.
